DRIVING UNDER THE INFLUENCE

On Mar. 11 at approximately 4:55 p.m. Officer Derek Mourato was driving on Bald Hill Road near Target when he saw the driver of a Jeep Grand Cherokee throw what appeared to be a nip bottle out of its window. The Jeep then turned into Best Buy, at which time Mourato pulled it over.

The driver was identified as Jonathan Dodge, 34, of 60 Quaker Dr. Apt. #7 in West Warwick. Dodge admitted to drinking the Vodka nip and throwing the bottle out of the window because he didn’t want to get charged with “open container.” He admitted to have had a few drinks at a friend’s house, from which he was driving home, and said he had been drinking since the previous night after getting into an argument with his wife.

The officer observed Dodge to have bloodshot eyes, an odor of alcohol coming from his breath, and slurred speech. Dodge agreed to field sobriety tests and stepped out of the vehicle. Officer Mourato observed him to be unsteady on his feet at this time.

During the tests, Dodge indicated impairment by hitting almost every clue during the horizontal gaze, walk and turn, and one leg stand tests.

Dodge was placed under arrest and transported back to police headquarters. His car was towed from the scene.

At the station, Dodge refused to submit to a B.A.C. test. He was charged with DUI 1st Offense, Refusal to Submit to a Chemical Test 1st Offense, Littering, and Inspection Sticker Required. He was then released to a sober adult.

POSSESSION

On Mar. 10 at approximately 1:18 a.m. Officer David Waddington was doing patrol in the area of Gillooly Dr. and Parkside Ave. off of Narragansett Pkwy. He heard an engine revving and an argument occurring between a woman, sitting inside a Honda CRV, and a man, standing outside of the car. The disturbance was occurring at a residence on Parkside Dr., which was not the residence of the individuals involved, who were later identified as Devon Morales, 21, of 51 Maude St. in Providence and Eden Rose, 27, of 149 Home Ave. in Providence.

Upon walking up to the vehicle, the officer saw heavy damage to the front of the car and saw a different vehicle, which had been parked in the driveway, pushed into the fence of the yard. Morales began talking to the officer, while Rose appeared to be acting erratic in the car and concealing something in her waistband.

The officer had Rose step out the vehicle and she appeared to be unsteady on her feet, her speech was incoherent, and she continued to attempt to conceal something in her waistband. Officer Waddington asked her to bring her hands up, which she ignored and said she was trying to pull her pants up. The officer then detained Rose against the front of the car and patted her down, at which time he also called for backup.

During the pat down, the officer found a clear plastic bag with blue capsules, with appeared to be powder inside, and called for a female officer to come to assist in a more thorough pat down, since he thought it to be narcotics.

He then placed Rose in the rear of his vehicle and spoke with Morales, who said they had been at a gentleman’s club earlier in the night and he thought that Rose had taken the drug “Molly,” and the pills she was carrying might be that substance.

Upon checking on her in the backseat, the officer observed Rose to be unable to sit still, sweating profusely, having dilated pupils, and her eyes were jerking back and forth. He also smelt alcohol on her.

The female officer from Providence arrived and conducted a pat down, finding a baggie that contained what appeared to be several large pieces of crack rock cocaine.

Due to her physical condition, Rose was transported to Kent Hospital.

At the hospital, Rose refused to take a chemical test.

During this time, the substance tested positive for cocaine and was placed into evidence. The blue pills, of which there were 26, came back positive for “Molly.”

Rose was discharged from Kent and taken to the police station. She was charged with Possession of Cocaine – Felony, DUI/Drugs/Alcohol – B.A.C. Unknown 2nd Offense, Driving on Suspended License 1st Offense, and Refusal to submit to Chemical Test 1st Offense. She was then held for bail.
